Welcome to Trust Carbon Protocol, a revolutionary platform for verification and certification of carbon credits developed and operated by PIESKE ONE LTDA, a company duly registered in Brazil.

By accessing our website, using our mobile application, or participating in any way in our pilot program, you ("User", "Participant" or "you") expressly agree to comply with and be bound by these Terms of Use ("Terms").

For better understanding of these Terms, the following definitions apply:

• "Trust Carbon" or "Platform": Refers to the Trust Carbon Protocol, including the website, mobile application, APIs, and all related services.
• "PIESKE ONE LTDA" or "We": The company that owns and operates the Trust Carbon Protocol.
• "Pilot Program": Initial testing and development phase of the platform, with limited functionality.
• "Verification": Process of analyzing and validating a rural property using satellite technology, AI, and on-site inspections.
• "Certification": Digital document issued after approval in the verification process, attesting to the property's eligibility.
• "Carbon Credits": Tradable units representing the removal or reduction of one ton of CO2 equivalent from the atmosphere.
• "CAR/SICAR": Rural Environmental Registry and Rural Environmental Registry System, Brazilian government databases.

Trust Carbon is currently in a pilot development phase. This means that:

• The platform is constantly evolving and improving
• Features and functionality may be added, modified, or removed without prior notice
• Bugs, technical failures, and temporary interruptions may occur
• The number of participants may be limited for controlled testing purposes
• User feedback is essential for ongoing development

During the pilot program, Trust Carbon offers the following services:

• We DO NOT guarantee timelines for commercialization of credits
• We DO NOT guarantee immediate connection with buyers or exchanges
• We DO NOT guarantee financial returns of any nature
• We ARE NOT an exchange, brokerage, or intermediary for carbon credits
• We DO NOT offer financial advisory or investment consulting services

To participate in the Trust Carbon Protocol, you must:

Personal Requirements

• Be at least 18 years of age
• Have full civil capacity
• Provide true, accurate, and up-to-date information
• Have no history of fraud or misconduct in environmental programs

Property Requirements

• Minimum area of 1 hectare (10,000 m²)
• Valid and verifiable property documentation
• Accessible location for on-site verifications (when applicable)
• Absence of active environmental embargoes
• Not located in permanent preservation areas without authorization
• For Brazil: CAR/SICAR registration (desirable but not mandatory)

Technical Requirements

• Android 8.0+ or iOS 13.0+ smartphone with functional GPS
• Internet access (Wi-Fi or mobile data)
• Ability to capture photos and videos
• Available storage space (minimum 2GB recommended)
• Camera with minimum resolution of 8MP

By using Trust Carbon, you agree to:

Permissions

• Use the platform only for legitimate carbon verification purposes
• Provide access to necessary application permissions (GPS, camera, storage)
• Allow location data collection during the verification process
• Authorize the use of data for analysis and platform improvement purposes
• Cooperate with security and anti-fraud verifications

Prohibitions

You MAY NOT:

• Attempt to circumvent security systems or anti-fraud verification
• Use rooted/jailbroken devices or emulators
• Falsify GPS data, photos, or any information
• Submit third-party properties without authorization
• Use the platform for illegal or fraudulent activities
• Reverse engineer the application or APIs
• Share access credentials with third parties
• Create multiple accounts for the same property
• Use unauthorized scripts, bots, or automation
• Sell, transfer, or sublicense your access

The privacy of your data is fundamental to us. We are committed to protecting your personal information and complying with LGPD (General Data Protection Law) and other applicable legislation.

Data Collected

• Personal Data: Name, email, phone, CPF/CNPJ, address
• Property Data: GPS coordinates, area, documentation, photos, videos
• Usage Data: Access logs, app interactions, device data
• Location Data: Real-time GPS during verifications
• Technical Data: IP, device type, operating system, identifiers

How We Use Data

• Process verifications and issue certifications
• Prevent fraud and ensure security
• Improve algorithms and analysis accuracy
• Communicate about verification status
• Comply with legal and regulatory obligations
• Develop and enhance the platform

Data Sharing

Your data may be shared with:

• Cloud service providers (AWS, Google Cloud)
• Technology partners (satellite analysis, AI)
• Government authorities (when legally required)
• Future credit buyers (anonymous/aggregated data only)

All content, technology, design, source code, algorithms, trademarks, and materials of the Trust Carbon Protocol are the exclusive property of PIESKE ONE LTDA or its licensors.

Trust Carbon Property

• "Trust Carbon Protocol" trademark and related logos
• Mobile application and web platform software
• AI algorithms and machine learning models
• Verification and analysis methodologies
• Interface and user experience designs
• Technical and scientific documentation
• Database and information structures

User Property

You retain ownership of:

• Photos and videos captured by you
• Property documentation provided
• Personal data and registered information

However, by using the platform, you grant Trust Carbon a worldwide, non-exclusive, royalty-free license to use, process, store, and analyze this data for service delivery purposes.

We Are Not Responsible For:

• Lost profits or loss of business opportunities
• Investment decisions based on our certifications
• Market fluctuations in carbon credit values
• Inability to sell certified credits
• Regulatory changes affecting eligibility
• Temporary technical failures on the platform
• Data loss due to network or device failures
• Third-party actions (hackers, attacks, etc.)
• Incorrect interpretations of reports by third parties
• Legal conflicts related to land ownership

Limitation of Damages

Under no circumstances will PIESKE ONE LTDA, its directors, employees, or partners be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenues
• Loss of data or information
• Loss of business opportunities
• Business interruption
• Costs of obtaining substitute services

Indemnification

You agree to indemnify and hold harmless Trust Carbon, PIESKE ONE LTDA, and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including attorney fees) arising from:

• Your misuse of the platform
• Violation of these Terms
• Violation of third-party rights
• Provision of false or misleading information
• Fraudulent or illegal activities

Trust Carbon reserves the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without prior notice.

Platform Modifications

We may, without prior notice:

• Add, modify, or remove features
• Change technical or eligibility requirements
• Adjust algorithms and methodologies
• Implement new security measures
• Change the interface or user experience

Terms Modifications

These Terms of Use may be updated periodically. When we make substantial changes:

• We will post the updated version on the website
• We will update the "Last Updated" date at the top of the document
• We will send email notification (for significant changes)
• We will request new acceptance when accessing the platform

Termination by User

You may close your account at any time by:

• Sending an email request to support@trustcarbon.org
• Using the "Delete Account" option available in the app

Note: Certifications already issued will remain valid and essential data will be kept for legal obligations.

Termination by Trust Carbon

We may suspend or terminate your account immediately, without prior notice, if:

• You violate any part of these Terms
• We detect fraudulent or suspicious activities
• You provide false or misleading information
• There is a violation of laws or regulations
• Your behavior harms other users or the platform
• The account remains inactive for an extended period
• Due to commercial or operational decisions

Effects of Termination

After account closure:

• Platform access will be immediately revoked
• Personal data will be treated according to the privacy policy
• Issued certifications will remain valid (except in cases of proven fraud)
• Confidentiality obligations remain in effect
• There is no right to refunds or compensation

These Terms of Use are governed by the laws of the Federative Republic of Brazil, without regard to conflict of law provisions.

Jurisdiction

The jurisdiction of Timbó, State of Santa Catarina, Brazil is elected, to the exclusion of any other, however privileged it may be, to resolve any doubts or controversies arising from these Terms.

Amicable Resolution

Before resorting to legal measures, the parties commit to attempting to resolve disputes amicably through:

• Direct contact with our support
• Extrajudicial mediation or conciliation
• Good faith negotiation

Entire Agreement

These Terms constitute the entire agreement between you and Trust Carbon, superseding all prior agreements, written or oral.

Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce it subsequently.

Assignment

You may not assign or transfer your rights and obligations under these Terms without our prior written consent. We may assign our rights freely.

Language

This document is available in English. In the event of translation into other languages, the Portuguese version shall prevail.
